These terms are the agreement between you and Clearway ("we", "us") when you use Clearway to ship goods from the United States to the Cayman Islands and have them cleared through customs. By creating an account or sending a package to your Clearway address, you agree to them.
1. What we do
We give you a US receiving address. We receive your packages there, ship them to Grand Cayman by air or sea, act as your customs broker with Cayman Islands Customs and Border Control (CBC), and hand them over to you in Cayman by pickup or home delivery.
As your broker, we prepare and file the customs declaration for your goods in your name, using the information and invoices you give us. You authorise us to do this for every package that arrives with your code.
2. Your account and your code
- Give your full name as it appears on your government ID, plus a working email and mobile number. Keep them up to date.
- Every package must carry your Suite code (CW-xxxxx) on Address line 2. We may hold a package without a readable code until we can confirm who it belongs to, and we aren't responsible for delays this causes.
- You are responsible for everything shipped to your code. Don't let anyone else use it.
3. Invoices and declared values
- Upload the seller's invoice for every package. Customs law requires us to declare the true price paid, and we can't clear a package without one.
- The invoice must be genuine and show what you actually paid. Under-declaring the value, or describing goods falsely, is an offence under Cayman Islands customs law. We will not file a declaration we believe is false, and we may report it.
- Any duty, penalty or fee CBC charges because of information you gave us is yours to pay.
4. What you can't ship
Don't send goods that are prohibited or restricted for import into the Cayman Islands without the right permit. That includes firearms and ammunition, controlled drugs, and anything on CBC's prohibited and restricted lists. Also don't send goods that air or sea carriers won't accept, such as explosives, flammable liquids and gases, loose lithium batteries, and other dangerous goods.
If such an item reaches us, we may refuse it, return it at your cost, or hand it to the authorities. Any fines or costs that result are yours. Some goods need a permit before they arrive. Getting that permit is your job, though we can tell you when one is needed.
5. Charges
Each delivery is invoiced in Cayman Islands dollars (CI$). An invoice can include:
- A flat shipping rate set by the size tier of the packed box
- The port authority fee
- Government import duty at the rate CBC applies
- Insurance
- An inspection fee if CBC inspects the goods
- A handling fee for oversize packages
- A home delivery fee if you choose delivery
Our current rates are shown in the app before you are invoiced. Duty is set by CBC, not by us, and can change if CBC reassesses a declaration.
6. Payment
Pay each invoice promptly once we send it, using the bank details in the app with the payment reference given. We release goods only once the invoice is paid in full.
7. Pickup, delivery and storage
Goods left uncollected for 90 days after invoice, with no reply to our reminders, are treated as abandoned. We may then dispose of them or sell them to recover what is owed, after giving you notice.
8. Loss, damage and claims
- Every delivery is insured for its declared value while it is in our care, from receipt at our US warehouse until handover in Cayman.
- Report damage or missing items promptly after the invoice, with photos and the packaging. Later claims may be refused.
- Our liability for any package is limited to its declared value plus the shipping charges paid for it. We aren't liable for indirect loss, such as loss of use or profit.
- We aren't responsible for poor seller packaging, for items that were already damaged or missing when the seller shipped them, or for delays caused by customs, carriers, weather or other events outside our control.
9. Customs inspections and holds
CBC can inspect, hold or reassess any shipment. We will tell you when that happens and what CBC needs, and we will help you respond. Delays caused by an inspection or hold are outside our control.
10. Ending your account
You can close your account at any time once your invoices are paid. We may suspend or close an account that breaks these terms, for example by false declarations, prohibited goods or unpaid invoices.
11. Changes to these terms
We may update these terms. We will tell you about significant changes by email before they apply. The version in force when a package arrives at our warehouse applies to that package.
12. Law
These terms are governed by the laws of the Cayman Islands, and the courts of the Cayman Islands decide any dispute.
