Clearway ("we", "us") is the data controller for the personal data described here, under the Cayman Islands Data Protection Act (2021 Revision). This policy explains what we collect, why, who we share it with, and your rights.
What we collect
- Account details: your name as on your ID, email address, mobile number, how you want updates sent, and your Cayman delivery address.
- Package and customs details: tracking numbers, photos of shipping labels and packages, weights and sizes, seller invoices, what you bought and what you paid, and the customs declarations and duty assessments we file for you.
- Payments: the invoices we issue and the payments you make. We don't store card details.
- Usage: sign-in records and the actions taken on your account, kept for security and audit.
Why we use it
- To receive, ship, clear and hand over your packages. That is the service you asked for, so this is necessary to perform our contract with you.
- To file customs declarations with Cayman Islands Customs and Border Control (CBC) and keep the import records the law requires. This is a legal obligation.
- To invoice you, collect payment and handle claims.
- To email you when we need something from you, such as an invoice, a document, a payment or a pickup. We don't send marketing without your consent.
- To keep the service secure and to prevent fraud and false declarations. These are our legitimate interests.
Who we share it with
- Cayman Islands Customs and Border Control, and other government bodies where the law requires it.
- Carriers and agents who move your goods, such as airlines, shipping lines and our US warehouse.
- Service providers who run parts of our service for us under contract: hosting and database, email delivery, messaging, automated reading of labels and invoices, and error monitoring with session replay (what you typed is masked). They may use your data only to provide that service to us.
We don't sell your personal data.
Transfers outside the Cayman Islands
Some of our service providers, and our receiving warehouse, are in the United States. Where we transfer data outside the Cayman Islands, we use providers with appropriate safeguards, as the Data Protection Act requires.
How long we keep it
We keep account details while your account is open. We keep customs, invoice and payment records for as long as Cayman customs and tax law requires us to keep import records, and no longer than needed after that. Label photos and documents you uploaded are deleted once the records they support no longer have to be kept.
Your rights
Under the Data Protection Act you can:
- Ask for a copy of the personal data we hold about you
- Ask us to correct data that is wrong
- Ask us to stop or limit using your data, or to delete it, where we have no legal need to keep it
- Object to direct marketing at any time
- Ask not to be subject to a decision made only by automated means
Reply to any email from us, or message us in the app, to use these rights. We will answer within 30 days. If you aren't satisfied, you can complain to the Office of the Ombudsman, which oversees data protection in the Cayman Islands.
Security
Your data is stored with access limited to staff who need it for your packages. Every change to your records is logged. Sign-in uses one-time codes and links instead of passwords.
Changes
If we make a significant change to this policy, we will email you before it takes effect.
